Costs

Package A

Consent Order - if you and your spouse are able to agree a fair financial settlement then this can be written into a consent order.

There will also be a court fee which currently £45.

The fixed price of £600 includes all the drafting for the Order and any negotiations with your spouse or their solicitor as to the wording but does not include any mediation or negotiations as to the actual financial settlement.  You and your spouse must have already reached an agreement or be in an amicable enough position that you can agree the terms of the financial settlement between yourselves.

The fixed price also includes the drafting of the forms to go with the Consent Order and correspondence with the Court to obtain sealing of the Order.

Package B

This package includes everything you need to finalise a legally binding financial agreement as long as you are able to agree a settlement with your spouse after financial disclosure.

The fixed price of £1,500 includes attendance upon you to take your instructions and advice on a possible financial settlement, writing to you with a client care letter and letter of advice, advice on the procedure and timescale, drafting and sending a letter to the other side to engage in negotiations, assistance in completing your financial disclosure on Form E, exchange of Form Es with the other side, advice on other side's Form E, guidance on what settlement you are entitled to, an offer letter to the other side, advice on any offer received, if an agreement is reached then drafting and obtaining a sealed consent order from the court, if an agreement is not reached advice as to the next steps available to you.

Package C

This package includes everything you need to issue a financial application at Court up to the first appointment at court. It does not include representation at the first appointment although we are able to offer this for a separate fixed fee.

The fixed price of £1,500 includes attendance upon you to take your instructions and advice on a possible financial settlement, referral to mediation (you have to attend this prior to issue of proceedings as stipulated by the law), writing to you with a client care letter and letter of advice, advice on the procedure and timescale, drafting and sending a letter to the other side, issue of Form A at Court, assistance in completing your financial disclosure on Form E, exchange of Form Es with the other side, advice on other side's Form E, guidance on what you are entitled to, an offer letter to the other side, advice on any offer received, all other preparation up to the first appointment at Court

Package D

This package includes everything you need from after the First Appointment up to the Financial Dispute Resolution Hearing. It does not include representation at the first appointment although we are able to offer this for a separate fixed fee.

The fixed price of £1500  includes all attendances upon you to take your further instructions and advice on a possible financial settlement, writing to you with a client care letter and letter of advice, advice on the procedure and timescale, all correspondence with the other side, advice on any offer received, all other preparation up to the FDR to comply with the Court’s directions which may include instructing an estate agent to carry out a valuation on the former family home or obtaining a valuation of your pension.

Package E

This package includes everything you need from the FDR up to the Final Hearing.  It does not include representation at the Final Hearing although we are able to offer this for a separate fixed fee.

The fixed price of £1500 includes all attendances upon you to take your further instructions and advice on a possible financial settlement, writing to you with a client care letter and letter of advice, advice on the procedure and timescale, all correspondence with the other side, all other preparation up to the final hearing to comply with the Court’s directions and instructions to a barrister to represent you at Court if required.

Package F

This service is suitable if you require some initial advice with regard to the financial aspects of your divorce and that you feel with the benefit of some mediation sessions together with your spouse you will be able to reach an agreement.

It is not suitable if your spouse is extremely antagonistic and is unlikely to co-operate with financial disclosure or turn up to mediation sessions.

The fixed fee of £400 covers taking your instructions, advice on a possible financial settlement, writing to you with a client care letter and detailed letter of advice, writing to your spouse to suggest mediation, referral to mediation and advice if required of up to one hour following the conclusion of mediation, writing to you to confirm the outcome of mediation and advice as to how to progress matters.


Notes
The fixed fee scheme requires you to provide reasonable instructions in a reasonable and timely manner.  We may withdraw the scheme if this is not the case.

If the proceedings become unexpectedly complicated we reserve the right to charge for this extra work on a time spent basis.

Fixed fees are only available for cases where the total assets are worth £500,000 or less.

If we need to involve outside experts, their fees will be charged in addition to the above fixed fee.  For example, we may need advice from pension experts, barristers and so on.

The fixed fees do not include representation at court hearings.  At some hearings we will be able to represent you and can agree a fixed fee for doing so beforehand.  At other times it will be appropriate for a barrister to represent you at a likely charge of between £500 to £2000 plus VAT depending on the experience of the barrister and the type of hearing.

The fixed fee packages are payable in monthly installments which we will agree with you at our first meeting.

Fixed fees are not suitable for everyone.  We will discuss them with you carefully before going ahead.  We reserve the right to refuse to offer fixed fees.
